Ethical AI refers to the responsible design, development, and use of artificial intelligence systems that respect privacy, fairness, transparency, and accountability.

In the context of the Digital Personal Data Protection Act, 2023 (DPDP Act), Ethical AI refers to practices that ensure artificial intelligence systems using personal data are designed and deployed responsibly. It focuses on ensuring that AI systems process personal data for appropriate purposes, maintain transparency, reduce unintended harms, and include safeguards that protect individuals' rights and interests.

AI systems often rely on large datasets that may include personal data for activities such as personalization, automation, fraud detection, customer service, and decision support. Without appropriate governance, AI systems may introduce risks related to excessive data collection, unclear processing purposes, inaccurate outputs, lack of transparency, or inappropriate use of personal data. Ethical AI practices help organizations establish responsible approaches for data usage, model governance, human oversight, and risk management.

The DPDP Act does not define Ethical AI as a standalone requirement. However, organizations using AI systems that process personal data must comply with applicable obligations relating to lawful processing, purpose limitation, notice, consent where applicable, security safeguards, and protection of Data Principal rights. Ethical AI practices can support organizations in building responsible AI governance aligned with privacy obligations.

In practice, gaps emerge when:

  • AI systems use personal data without clearly documented processing purposes.
  • Organizations cannot explain how AI systems use or generate outputs involving personal data.
  • AI models are deployed without privacy risk assessments.
  • Personal data used for AI training is not properly governed.
  • Human oversight is missing for AI-driven decisions affecting individuals.

Organizations address these risks by implementing AI governance frameworks, documenting data usage, conducting privacy assessments, maintaining human oversight, and establishing accountability mechanisms.
