Lawful Purpose
Definition
Lawful purpose refers to processing personal data only for purposes permitted under applicable laws, including the requirements established under the DPDPA.
Under the Digital Personal Data Protection Act, 2023 (DPDP Act), lawful purpose refers to a purpose for which a Data Fiduciary is permitted to process personal data under the Act. The DPDP Act requires that processing of personal data must be carried out for a lawful purpose, meaning the processing activity should not violate any applicable law and should be connected to a valid basis for processing.
A Data Fiduciary may process personal data based on the consent of a Data Principal or for certain Legitimate Uses specified under the DPDP Act. Ensuring a lawful purpose helps organizations avoid collecting or using personal data without justification, and supports responsible processing practices by requiring organizations to understand why personal data is being collected and used.
The DPDP Act requires organizations to provide clear information to Data Principals through a Notice, including details about the personal data being collected and the purpose of processing. Processing personal data beyond the communicated purpose or without a valid basis may create compliance risks. Maintaining purpose clarity helps Data Fiduciaries demonstrate accountability and align processing activities with DPDPA obligations.
In practice, gaps emerge when:
- Organizations collect personal data without clearly defining the purpose of processing.
- Personal data is reused for purposes not communicated to Data Principals.
- Teams cannot identify the legal basis supporting personal data processing.
- Processing activities are not documented across systems and departments.
- Business requirements change without reviewing privacy implications.
Organizations address these challenges by documenting processing purposes, maintaining data inventories, reviewing processing activities, updating notices where required, and aligning data usage with defined purposes. Within Privy, capabilities such as data discovery, data mapping, consent management, privacy workflows, and compliance reporting help organizations maintain visibility into personal data processing and support DPDPA accountability.
