Right to Nominate
Definition
Right to Nominate allows a Data Principal to nominate another individual who may exercise certain rights on their behalf under the DPDP Act.
Under the DPDP Act, the Right to Nominate allows a Data Principal to nominate another individual who can exercise certain rights of the Data Principal in accordance with the provisions of the Act.
This right provides continuity in managing personal data-related requests in situations where the Data Principal is unable to exercise their rights. A nominee may represent the Data Principal for applicable privacy-related matters, subject to the conditions and processes established under the DPDP framework.
For Data Fiduciaries, supporting the Right to Nominate requires appropriate mechanisms to record nominations, verify nominee requests, and manage interactions while protecting the privacy and security of personal data.
In practice, gaps emerge when:
- Organizations do not have a process to capture nomination requests.
- Nominee identities are not properly verified.
- Privacy workflows do not support nominee-related requests.
- Teams lack clarity on when nominee rights can be exercised.
- Nomination records are not maintained securely.
Organizations address these challenges by implementing nomination workflows, maintaining records, verifying requests, defining responsibilities, and integrating nomination handling into Data Principal rights processes. Within Privy, capabilities such as rights management workflows, request tracking, and compliance reporting help organizations manage privacy-related requests efficiently.
